When the Gelt is Gone: Bankruptcy and Foreclosure in Jewish and American Law Hosted by Beth Am Israel 1301 Hagys Ford Road, Penn Valley, PA 19072 1:00 pm – 4:15 pm Carolyn Hochstadter Dicker, Esq. Barbara Fein, Esq. Rabbi Margot Stein In the wake of the economic downturn of the last few years, attorneys have been dealing with growing numbers of bankruptcy and foreclosure cases. Ms. Hochstadter Dicker will provide strategies to be adopted under chapters 7, 11 and/or 13 of the bankruptcy laws for the individual and small business with respect to personal/corporate asset and income protection, credit issues, restructuring or unwinding, as well as collections proceedings from creditors, who may themselves be financially strapped.
Ms. Fein will follow with a segment on foreclosures including the obligation to perform due diligence prior to referring a file for foreclosure, unsavory “foreclosure avoidance” companies trying to cash in on borrowers’ suffering, and the challenges associated with protecting the privacy and confidentiality of borrowers in default. Rabbi Stein will conclude with the Jewish law content on general contract law and business ethics concerning defaulting on loans, creditor and debtor responsibilities, and how debt forgiveness in the sabbatical and jubilee years are handled in order to maintain the flow of business.
